Yark Inc. Terms of Use & Host Agreement
Version 3 - Effective Date: April 1, 2026
1. Nature of the Platform
Yark Inc. is a technology marketplace that connects parking Hosts and Users. Yark does not own, lease, control, or operate parking spaces and is not a party to any agreement between Users and Hosts.
2. No Agency Relationship
Yark is not an agent, broker, insurer, or fiduciary. No partnership, joint venture, or employment relationship exists between Yark and any user.
3. Event-Based Risk Disclosure
Users acknowledge risks associated with event parking, including congestion, restricted access, law enforcement activity, and towing. Users assume all such risks.
4. User Responsibilities
Users must comply with all laws, follow Host instructions, and are responsible for fines, towing, or damages caused.
5. Host Responsibilities
Hosts warrant legal control of the space and compliance with all laws. Hosts are fully responsible for safety, condition, and legality of listings.
6. Payments & Chargebacks
Yark may process payments, deduct fees, and withhold funds. Users agree not to initiate unjustified chargebacks. Yark may recover funds and suspend accounts.
7. No Guarantee
Yark does not guarantee availability, accessibility, or suitability of parking spaces.
8. Insurance Disclaimer
Yark provides no insurance coverage. Users and Hosts are responsible for their own insurance.
9. Assumption of Risk
All users assume risks including theft, damage, injury, and unsafe conditions.
10. Limitation of Liability
Yark is not liable for any damages. Total liability is capped at $100 or fees paid in the last 12 months.
11. Indemnification
Users and Hosts agree to defend, indemnify, and hold harmless Yark Inc. from all claims, including injury, damage, disputes, legal violations, and related costs, including attorney fees.
12. Disputes
Yark is not responsible for disputes between Users and Hosts.
13. Account Enforcement
Yark may suspend accounts or remove listings at any time.
14. Arbitration
All disputes shall be resolved through binding arbitration in Delaware. Users waive jury trial and class actions.
15. Governing Law
These Terms are governed by Delaware law.
16. Electronic Agreement
By using the platform, you agree to these Terms electronically.
Host Agreement
17.1 Independent Contractor
Hosts are independent contractors.
17.2 Full Liability
Hosts assume all liability for property condition, safety, and access.
17.3 Compliance
Hosts must comply with all applicable laws and regulations.
17.4 Host Indemnification
Hosts indemnify Yark for all claims related to their property or actions.
17.5 Payout Risk
Yark may withhold or reverse payouts for disputes or violations.
17.6 Listing Removal
Yark may remove listings at its discretion.
