Terms of Service

1. Nature of Service

Yark operates solely as an online marketplace that connects individuals who own or control parking spaces (“Hosts”) with individuals seeking parking reservations (“Renters”).

Yark is not a parking operator, transportation provider, landlord, real estate broker, or insurer.

Yark does not own, lease, control, manage, inspect, or operate parking locations listed on the Platform.

Yark’s role is limited to facilitating listings, reservations, payments, and communications between users.

All agreements concerning use of a parking space are solely between Hosts and Renters.

2. User Eligibility

You represent and warrant that:

• you are at least 18 years old;
• information you provide is accurate;
• you possess authority to enter agreements;
• your use complies with applicable laws.

Yark may suspend or terminate accounts at its sole discretion.

3. Host Responsibilities

Hosts represent and warrant that:

• they own, lease, or possess legal authority over listed spaces;
• listing a parking space does not violate any law, HOA restriction, lease agreement, zoning rule, or contractual obligation;
• listings accurately describe location, dimensions, restrictions, and availability;
• parking spaces are reasonably safe and accessible.

Hosts are solely responsible for:

• local compliance
• taxes
• permits
• signage
• disputes
• property conditions
• injuries occurring on property

4. Renter Responsibilities

Renters agree:

• to use parking spaces only for lawful purposes;
• to comply with Host instructions;
• not to block driveways, sidewalks, fire lanes, neighboring property, or emergency access routes;
• not to engage in unlawful conduct.

Renters assume all risk associated with entering and parking on private property.

5. Reservations Not Guaranteed

Yark does not guarantee:

• space availability;
• uninterrupted access;
• parking conditions;
• suitability of spaces;
• event schedules;
• venue access;
• traffic conditions.

Events may change, cancel, or experience delays.

Yark is not responsible for losses arising from such circumstances.

6. Payments and Fees

Payments are processed through third-party payment providers.

Users authorize Yark to collect, process, and distribute applicable fees.

Yark reserves the right to:

• assess service fees;
• modify fee structures;
• withhold payouts for fraud investigations;
• issue credits or refunds.

Payment processor terms may also apply.

7. Host Payout Timing

Yark may delay payouts for:

• fraud review
• chargebacks
• payment disputes
• platform investigations
• suspected misuse

Payout timing estimates are not guarantees.

8. Cancellation Policy

Reservations canceled by Renters may be subject to cancellation fees.

Hosts may face penalties for repeated cancellations.

Yark reserves sole discretion regarding refunds, credits, and dispute resolution.

Emergency circumstances, weather events, venue changes, or force majeure events may affect reservation eligibility.

9. Damage, Theft, and Personal Property

YARK DISCLAIMS ALL RESPONSIBILITY FOR:

• vehicle theft
• vandalism
• accidents
• towing
• property damage
• bodily injury
• lost items
• criminal acts

Users park and use properties entirely at their own risk.

Yark does not provide vehicle insurance, premises insurance, or property protection.

10. Assumption of Risk

You acknowledge that entering private property and participating in peer-to-peer transactions involves inherent risks.

You voluntarily assume all risks arising from use of the Platform.

11. Release of Claims

To the fullest extent permitted by law, users release Yark and its officers, directors, employees, affiliates, contractors, and agents from any claims arising out of:

• property disputes
• personal injury
• parking incidents
• vehicle damage
• user misconduct
• third-party actions

12. Indemnification

You agree to defend, indemnify, and hold harmless Yark and its affiliates from claims, damages, liabilities, costs, and expenses arising from:

• your use of the Platform;
• your violation of these Terms;
• disputes with other users;
• violation of laws;
• injury or property damage.

This includes attorneys’ fees.

13. User Content

Users retain ownership of uploaded photos and content.

By submitting content, you grant Yark a worldwide, royalty-free, perpetual license to display, reproduce, distribute, and promote such content.

Yark may remove content at any time.

14. Prohibited Conduct

Users may not:

• create fraudulent listings
• manipulate pricing
• scrape platform data
• reverse engineer systems
• use bots
• impersonate others
• circumvent fees
• submit false claims

Violation may result in account termination.

15. Arbitration Agreement

Any dispute relating to these Terms shall be resolved exclusively through binding arbitration.

Users waive any right to participate in class actions or jury trials.

Arbitration shall occur in Illinois under the rules of the American Arbitration Association.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

YARK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

YARK’S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

• (a) amounts paid through the Platform in the preceding twelve months, or
• (b) $100.

17. Force Majeure

Yark shall not be liable for delays or failures resulting from:

• weather
• natural disasters
• stadium closures
• internet outages
• governmental actions
• strikes
• civil disturbances
• third-party failures

18. Governing Law

These Terms shall be governed by Illinois law without regard to conflict of law principles.

19. Modification of Terms

Yark may modify these Terms at any time.

Continued use constitutes acceptance.
